BOARD OF HEALTH MEETING
MARCH 27, 2008

PRESENT: Paul Lothrop, Chairman, Beverly Knox, Dr. James Taylor,

OPENING STATEMENTS
The Health Agent asked if the Board would be able to attend a presentation by Susan Rask and Chris Burt. This presentation would update the Innovative Alternative (I/A) systems in Eastham- how many are installed, where they are located, how are the systems performing, etc. The Board agreed that Tuesday April 15, 2008 at 11-12 would be a good date to schedule the meeting.
APPEALS FROM FEBRUARY 28, 2008 MEETING
McShane Construction 3 Stellwagen Way Map-8 Parcel-191A
Glenn Dumont presented the plan to finish a room in the basement. The project was approved with the following conditions:
1. 1 bedroom deed restriction to be recorded
No plumbing to be installed in the basement
Dr. Taylor made the motion to approve the plan with the 2 conditions.
Beverly Knox seconded the motion.

Robert Salva 20 Beach Road Map-19 Parcel-28
Jeff Conlon representing Mr. Salva requested the rental permit at 20 Beach Road allow occupancy for 6 people , since this property has been rented in the past for 6 people.
The Town Clerk, Lillian Lamperti spoke stating that the applicant applied for a permit for 6 people but based on room size criteria it was determined the total allowed occupancy would be for 4 people.
There was a long discussion about this problem. The Board recommended that in the year 2009 the occupancy limit will be reconsidered after further consideration.
Dr Taylor made the motion to grandfather the rental permit to allow occupancy for 6 people.
Beverly Knox seconded the motion .

REVIEW DRAFT OF SEPTIC PUMPING INFORMATION
The draft was submitted for review.
VARIANCES
Cathy Sanders 75 South Eastham St. Map-21 Parcel-12
Cathy Sanders submitted plans requested variances resulting from the location of the proposed garage to the existing septic components , no increase in flow will result. Felco engineered the plan dated 1/2/2008. The variances requested are as follows:
2' from septic tank to slab -310 CMR 15.211
7' from leach area to slab
Finding that the plan achieves feasible compliance the board approved the proposed plan as presented with these conditions:
No increase in flow allowed
Deed restriction to 3 bedrooms
D Box to be replaced with H20 D Box
Beverly Knox made the motion to approve the plan with the 3 conditions.
Dr. Taylor seconded the motion.

Marc & Sandra Zimmermann
David Lajoie presented plans to upgrade the septic system for the existing 3 bedroom dwelling with the proposed addition. The following variances requested are as follows:
1. 7' from existing septic tank to cellar wall (A) -310 CMR 15.211
8' from existing septic tank to proposed cellar wall (B)
6' from proposed leach area to cellar wall (A)
6' from proposed leach area to proposed cellar wall (B)
4' from proposed leach area to lot line (Pcl. 465)
Finding that the plan achieves maximum feasible compliance, the aforementioned variances were approved with the following conditions:
1. No increase in flow allowed.
Deed restriction to 3 bedrooms.
Confirm study has 4 ft. opening as required so it does not meet definition of a bedroom.
Beverly Knox made the motion to approved the plans with the 3 conditions.
Dr. Taylor seconded the motion.

REQUEST TO DELAY OIL TANK REPLACEMENT
Chris & Elaine Clarke 8 Settler’s Trace Map-18 Parcel-185
Elaine Clark requested to delay the oil tank replacement for one year. The Board approve the delay for one year with the one condition that a letter be submitted confirming the tank was made in the USA.
Beverly Knox made the motion to approve with the one condition.
Dr. Taylor seconded the motion.

REQUEST REDUCTION OF TESTING SECONDARY TREATMENT
Joyce M. Bamford 17 Beach Plum Lane Map-13 Parcel-185
The Board approved Joyce M. Bamford request to allow testing of the septic tank effluent for total nitrogen BOD, TSS, PH, and nitrate-nitrogen (not to exceed 19mg/1) 2 times per year if used seasonally.
Dr. Taylor made the motion to approve this request.
Beverly Knox seconded the motion.

CORRESPONDENCE / OTHER BUSINESS
RE: 35 Asa’s Road Map-4 Parcel-86
A complaint letter was submitted to the Board concerning the proposed plans for an eight-room dwelling at 35 Asa’s Way. Jane McMahan at 60 Asa’sWay had concerns that the lot was too small for such a large house.
RE: Viking Shore 5200 State Highway Map-5 Parcel-13
Attorney, Ben Zehnder was present to represent the Viking Shores.
The Eastham Board of Health requested that Massachusetts Department of
Protection be contacted to consult with Eastham Health department to further evaluate site plans, septic reports and regulatory requirements related to the septic systems and public water supply located at 5200 State Highway.
The Board requested the Health Agent consult with the DEP for advice concerning the system identified as “Managers Quarters”.
Beverly Knox made the motion to consult with the Massachusetts Department of Environmental Protection for advise.
Dr.Taylor seconded the motion.
